Sonam Wangchuk: Delhi HC Refuses Interim Relief on Wife's Plea, Seeks Replies from Centre & Hospital

The Delhi High Court has denied interim relief regarding a plea to transfer a fasting activist from a government hospital to a private medical facility. The activist's spouse alleged that the forced hospitalization was a deliberate attempt by authorities to prevent participation in an upcoming protest march scheduled to coincide with the monsoon session of Parliament. The family contested the official medical reports, claiming independent tests showed normal health parameters, and questioned the heavy police presence at the hospital. During the hearing, the government argued that the activist was neither arrested nor detained, but was moved to the government hospital due to deteriorating health during the hunger strike. The Additional Solicitor General stated that the government must remain cautious, as any adverse impact on the activist's health could lead to severe consequences outside the hospital. The court observed that the initial transfer was justified for health reasons and adjourned the matter, requesting a status report from the government and police while allowing the activist to consent to medical treatment.
