Madras High Court Calls for Transgender Rehabilitation Scheme, Grants Bail To YouTuber
The Madras High Court directed the Tamil Nadu government to design a comprehensive rehabilitation framework for transgender persons. The observations were made by Justice K.K. Ramakrishnan. The matter arose from an anticipatory bail plea filed by a YouTuber linked to a video on a tragic self-immolation incident involving a transgender individual at a police station.The Court granted anticipatory bail after examining the material on record. It found that the petitioner only retransmitted content already available in the public domain. The Court noted that no independent fabrication or fresh allegation emerged from the video. The petitioner also removed the video after realising its impact. In such circumstances, custodial interrogation did not appear necessary.The Court recorded strong observations on the continued marginalisation of transgender persons and the failure of society to ensure dignity and inclusion."Transgender persons are not strangers to our social fabric and the tragedy is not in their birth, it is in the blindness of society which, by exclusion and prejudice, has driven them into conditions of extreme marginalization..," the Court said.The Court said that discrimination and exclusion push many into vulnerable conditions.The Court also referred to the landmark decision of the Supreme Court in National Legal Services Authority v. Union of India, wherein it recognised transgender persons as a third gender and affirmed their fundamental rights. The Court observed that the directions issued in that judgment still remain inadequately implemented."They are entitled to be accepted as equals, as members of families, as participants in the common destiny of this nation. It is no part of judicial function to sit in theological judgment over the Creator ..," it noted.The Court held that constitutional guarantees under Articles 14, 15, 16 and 21 require active State intervention.The Court ordered the State to frame a Taluk-level rehabilitation scheme. The scheme must focus on self-employment, sustainable livelihood, and access to education and healthcare.The Chief Secretary of Tamil Nadu is also directed to coordinate across departments to implement these measures. A compliance report is due by July 26, 2026.
