Unsuccessful appeal sees planning commission refuse permission for 16 Passage West homes
Plans for more than 15 new homes have been refused by the planning commission following an appeal by the developer.O’Brien and O’Flynn lodged plans with Cork County Council in August last year to build 16 new two-storey homes at Harbour Heights, Ardmore, in Passage West. The homes were to comprise two three-bedroom semi-detached units, three three-bedroom terraced houses, nine two-bedroom terraced houses and two two-bedroom homes, as well as all associated site development works.Refusing the plans, Cork County Council said the proposed development was planned for a site reserved for a nursing home.“A section 47 legal agreement has been entered into to this effect, and as such it is considered that the subject site should be reserved for a nursing home and that the proposed development would be contrary to these requirements,” the council said.Siding with the council, An Coimisiún Pleanála refused the plans, generally in accordance with its inspector report.In its decision, the commission said there was an absence of “sufficient justification” for using the land for residential purposes instead of a nursing home.
