MISTRIAL now at 80% odds in the Lindsay Clancy case. A woman was ARRESTED in the courthouse parking lot for secretly filming the jurors, hours before the judge dropped the "dynamite charge."
Five days of jury deliberations and almost 30 hours. Two formal notes saying the same thing: we CANNOT agree. On Wednesday, September 2, Judge William Sullivan read the twelve jurors in Plymouth Superior Court the most forceful instruction Massachusetts law allows, the Tuey-Rodriguez charge, known as the "dynamite charge" because it's meant to blast a deadlocked jury out of an impasse.
But before he could address that deadlock, he had to deal with something stranger: a 56-year-old retired nurse allegedly caught recording jurors from a restricted courthouse lot, now charged with juror intimidation.

QUESTIONS PEOPLE ARE ASKING
Is the Lindsay Clancy jury deadlocked? Yes. Jurors sent notes Tuesday and Wednesday saying they could not reach a unanimous decision.
What is a Tuey-Rodriguez charge? Massachusetts' version of the national "Allen charge", it asks deadlocked jurors to re-examine their views with an open mind without abandoning honestly held convictions. From Commonwealth v. Tuey (1851), revised in Commonwealth v. Rodriguez (1973).
Does a hung jury mean Lindsay Clancy goes free? No. A hung jury counts as "manifest necessity," so double jeopardy does not bar a retrial. The indictment stays alive and the decision falls to the Plymouth County DA.
Who was arrested at the Clancy trial? Dawn Light, 56, of Sutton, Massachusetts, arraigned Wednesday on a witness/juror intimidation charge. She pleaded not guilty and was released on personal recognizance.
I want to be clear about something. I'm not here to tell you what the verdict should be, and I understand why twelve reasonable people cannot agree.
What I do believe is this: a mother cycled through 13 psychiatric medications, sat through 15-minute video appointments, and still ended up here. That part isn't only a jury question, but a system question, and we're all living in that system.
