Maharashtra FDA Action Flagged: Bombay High Court Questions Enforcement Drive | WION

Bombay High Court has pulled up the Maharashtra Food and Drug Administration (FDA) over what it described as an overly aggressive approach to enforcement. The court’s observations came while hearing separate cases involving pharmaceutical company SPLA and five eateries at the Mumbai Cricket Association premises in Bandra Kurla Complex.

The sharper criticism came in the MCA restaurant case, where the FDA had suspended the licences of five eateries. A subsequent inspection reportedly found the establishments to be 88% compliant with food safety requirements, prompting the court to question why enforcement action continued.

The Bombay High Court observed that the FDA had acted with undue haste and adopted a pedantic rather than pragmatic approach. The court also questioned the department’s failure to reconsider its action after being directed to do so.

The development comes as Maharashtra FDA Commissioner Tukaram Modi leads a wider enforcement drive against alleged food and drug safety violations across the state.
